In Montevideo in Urugyay, a judge has decided that it is not the court's place to decide for an 11 year old girl that is mentally disabled if she can have an abortion even though her mother gave her full support.

 

The Judge, Raquel Gini said that the girl supposedly wants to continue with the pregnancy and with the relationship she has with the father of the unborn child. The father, now imprisoned, is a 41-year-old man that has been accused of sexually abusing the young girl.

 

On Friday, a spokesperson for the court said that according to the Chilean law, “a decision should be reached between the girl, her mother and the doctors.”

 

It is expected that the mother will stop trying to seek a forced abortion through the courts after this ruling, as doctors have found that the pregnancy poses no medical risks to the young girl, despite her lack capability of fully understanding the situation that she is in. Some may argue however that it poses psychological risks to the girl.
